Waiver

Once you have agreed to the disclaimer and Waiver electronically, you acknowledged that you have read and understood the information presented to you as part of sign in and sign up process as well as registration for any events.

You accept and agree that events carry certain inherent dangers and risks which may or may not be readily foreseable, including without limitation to personal injury, property damage or death.

In consideration of allowing the below undersigned participant or participants (here on known as Participant) to compete or participate in any way in the above event and/or activities (registered through this website) , for himself/herself, his/her personal representatives, agrees as follows:

The Participant fully and forever releases from all liability, including negligence, the event organizer ('Organizer'), online registration company, sub-contractors, all municipal agencies whose property or personnel are used, all Sponsoring and Co-Sponsoring companies or individuals related to the Events, and their respective employees, agents, volunteers and affiliates, including negligent rescue operations and is intended to be as broad and inclusive as is permitted by the Malaysian law in which the Event is conducted. (hereforth collectively refers to 'Releasees')

Event.fynter.com only acts as a portal for registrations and will not be liable or responsible for any claims by the Participants due to whatsoever issues regarding or caused by the Organizer.

The Participant waives the ultimate right to sue the Releasees for any and all claims, demands, losses or damages of the Participant on account of any injury, including, but not limited to the death or injury of the Participant or damage to property, all of which is caused or alleged to be caused in whole or in part by the negligence of the Releasees or otherwise.

The Participant warrants that he/she is in good physical condition and have sufficient preparations and is able to safely participate in the Events. The Participant is fully aware of the risks and hazards inherent in participating in the Events, including the possibilities of serious physical trauma, injury or death.

The Participant grants to the Organizer or Event Owner to the use of the Participant's name and photographs in broadcasts, newspapers, magazines, brochures, internet website, and other media without compensation or prior notice.

The Participant acknowledges that the entry fee and the transaction cost (if any) of the Events, is non-refundable, non-transferable and non-deferrable.

The Participant acknowledges that the Organizer of the Events has the right to alter, change, cancel and/or postpone any of these events as a results of circumstances that would direct affect or impact the event which is or beyond control.

REGISTRATION AGREEMENT & LIABILITY WAIVER (the Agreement and Waiver)

You represent and warrant to event.fynter.com including all its subsidiaries and affiliated entities ('Fynter') as the authority to Register and/or Acts as Agent on behalf of the Organizer with full legal authority to complete the registration of the Events on behalf of yourself and/or any party(s) you are registering (the 'Registered Parties') through the registration portal event.fynter.com.

This warrant includes the full authority to utilize the credit / debit card or online bank transfer to which registration fees and other transaction fees (if any) are to be charged. You also hereby free Fynter of any and all potential claims related to the credit card and debit card transactions done over event.fynter.com registration portal.

By signing up for and providing any information, personal or otherwise, in order to gain access to the Event or any activity(ies) involving the Organiser and the Event sponsors (if any) , the individual ('Participant') is deemed to have agreed to the following :

PERSONAL DATA PROTECTION POLICY

The Personal Data of the Participant will not be shared by Fynter without your consent to the third parties. However, it shall be used by the Organiser and Online Portal for the purposes of sending communication materials to the Participant, including but not limited to, direct mailers, emails, Short Messaging Service and/or telephone calls.
The Organiser may engage the services of third parties to process the Participant's Personal Data. All such third parties are contractually obliged not to use the Participant's Personal Data for any other purpose, other than as specified herein.
The Participant has the right, at any time, to:
withdraw his/her consent for the use of the Personal Data;
to request for any correction/update of the Personal Data;
raise any general queries regarding the use of his/her Personal Data;
by contacting the organisers directly or email to support@fynter.com. Organisers' email and contact numbers are listed in the event details.
You understand and fully aware on the risks and its potentially hazardous and that a registered participant MUST not participate unless you are medically able and have sufficient training and preparations. The Risk includes minor injuries to major and fatal injuries resulting to death.

You and the Registered Parties together with the heirs, personal representatives or assigns or executors do hereby release, waive, discharge and convenant not to sue Fynter for any and all liability from any and all claims arising from the participation in the events by you or any other registered party.

Fynter makes no warranty and assurance that the services in event.fynter.com registration portal will be uninterrupted, secure or error free. Fynter also do not guarantee the accuracy or completeness of any information, or provided in connection to the Events or otherwise in the website.

You agree that this Agreement and Waiver is govern and construed in accordance to the laws of Malaysia. You further agree that this Agreement and Waiver is intended to be as broad and inclusive as is permitted by law of Malaysia. By accepting this Agreement and Waiver, you are affirming that you have read, understood and fully agreed to the terms and you will give up substantial rights, including the rights to sue and to release all liability to the greatest extend allowed by law.
